These Terms and Conditions ("Terms") govern your use of the website hugemistake.ch and any services provided by HUGEMISTAKE ("we", "us", "our"), a creative development studio based in Geneva, Switzerland. By accessing our website or engaging our services, you agree to be bound by these Terms.

All project engagements are governed by a separate project proposal or statement of work (SOW) agreed upon by both parties before work begins. The SOW will outline scope, timeline, deliverables, and pricing. Any changes to the agreed scope require written approval from both parties and may affect timeline and pricing.
Unless otherwise specified in the project SOW:
Upon full payment, all custom code, designs, and deliverables created specifically for your project are transferred to you. HUGEMISTAKE retains the right to use general techniques, tools, and knowledge gained during the project. We also retain the right to showcase the work in our portfolio unless a non-disclosure agreement is in place. Third-party licenses (fonts, libraries, stock assets) remain subject to their respective license terms.
Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This includes business strategies, technical architectures, client data, and financial information. Confidentiality obligations survive the termination of any agreement for a period of two years.
HUGEMISTAKE's total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific project in question. We are not liable for indirect, incidental, or consequential damages including but not limited to loss of revenue, data, or business opportunities. Our website and its content are provided "as is" without warranties of any kind.
Either party may terminate a project engagement with 14 days written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Any materials or deliverables produced up to that point will be delivered to the client upon receipt of outstanding payment.
These Terms are governed by and construed in accordance with the laws of Switzerland. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
